MacStadium provides data hosting, storage, computing resources, and other private cloud related services to its customers (“Services”). This Privacy Policy describes the types of information we may collect from you or that you may provide when you when you interact/communicate with MacStadium, including visiting websites (herein known as “website”, “website(s)” “site” or “site(s)”), which also includes, but not limited to, our practices for collecting, maintaining, protecting and disclosing that information so that you may decide whether or not to provide information to us.



This Privacy Policy may change from time to time.



For purposes of this Privacy Policy, the term “visitor” includes visitors to our site who are not yet customers, whether they become customers, as well as those (including customers) who provide information to our site, download it, communicate with us or are merely visiting our site.



Visitors may elect not to provide certain information to MacStadium and its affiliated websites. By doing so though, the visitor may not be able to access or take advantage of certain features.

WHAT INFORMATION DOES MACSTADIUM AND ITS AFFILIATES COLLECT?



We collect several types of information from and about visitors to our site(s) which are organized into three groups: Analytical Data, Personal Data and Visitor Contributions.



Analytical Data. MacStadium may collect the following analytic data: (a) Internet Protocol (IP) address; (b) Web pages requested; (c) Referring web page; (d) Browser used; (e) Access date and times; (f) information about your internet connection, (g) the equipment you use to access our websites or (h) usage details.



Personal Data. MacStadium may collect information about visitors by which they may be personally identified, including but not limited to: (a) First and Last Name; (b) Address; (c) Phone numbers; (d) Email addresses; (e) IP Addresses.



Visitor Contributions. MacStadium may collect and utilize information provided by Visitors that contains content created at the discretion of the visitor. This information may take the form of (a) Live Chat messages, (b) Telephone/voice- chat conversations, (c) Website product and service selections and orders or (d) Weblog comments.

HOW DO WE COLLECT INFORMATION?



We collect information from a variety of sources, including from you when you visit our site, communicate with us, or use our services; from our customers, who may provide information about their users or employers, including to manage accounts and services (such as name, contact, information and role) or as part of ad hoc data uploaded or provided to our hosted storage or systems; from third parties in connection with analytics or cookies deployed on our sites.



Web Visit and Communications. You may visit our site(s) in any of the following ways: (a) by using your browser to navigate to our websites; (b) by viewing an advertisement displayed on a third-party website that is served content by our web server or a web server affiliated with us; and/or (c) by viewing an email that is served content by MacStadium or a third-party web server. We collect information from these visits and when you choose to communicate with us.



Information We Collect through Automatic Data Collection Technologies. We may collect information from you automatically through data collection technologies, as described below. When you visit our websites, our server logs your IP address (a unique network address), the time and duration of your visit and the time and duration that you view of the pages on our websites. If you arrive at our websites by clicking a paid advertisement (including a paid search engine result) or a link in an email, then we will capture information that tracks your visit from that link. If you arrive at our websites by clicking a non-paid source, such as link in a non-paid search engine result or an unsponsored link on another website, we may capture information that tracks your visit from that source to the extent we are able to do so. IP address may also be used for troubleshooting purposes.



Information You Provide Us. We may collect information from you directly when you provide it to us. The information we collect may include: (a) Information that you provide by filling in forms on our websites, which includes information provided at the time of registering to use our websites, subscribing to our services on a trial or ongoing basis, posting content, or requesting further services and orders; (b) Records and copies of your correspondence if you contact us, which includes information such as email addresses Live Chat messages, Telephone/voice-chat conversations and Weblog comments; and (c) Details of transactions you carry out through our websites and of the fulfillment of your orders, such as payment or financial information that is required before placing an order through our websites. Cookies. MacStadium’s site(s) uses 'cookies'. A cookie is a piece of data stored on the visitor's hard drive containing information about the visitor/user. Usage of a cookie enables us to track and target the interests of our users to enhance the experience on our site if a user rejects the cookie, they may still use our site. The only drawback to this is that the user may be limited in some areas of our site (for example, certain surveys or other such activities).



A cookie is a unique identifier that enables us to track information and target the interests of our visitors/users to enhance the experience on our website (i.e., help us identify the number of unique visitors to our website(s), and whether or not those visitors are repeat visitors and the source of their visits). THIRD PARTY USE OF COOKIES.

  • To provide our Services. If you are a MacStadium customer, we provide you access to hosted systems and data stored with us. Depending on your services, we may also enable you to access and configure remote access to your Mac devices for your workforce. We provide customers the ability to manage particular user accounts.
  • To set up your account, to process and display your transactions and payments, and to permit you to participate in interactive features on our site.
  • To maintain, analyze, customize, and improve your experience on our site.

HOW TO EXERCISE YOUR RIGHTS



To exercise your rights, please contact us by using the information in the Contact Information section below. Your Personal Data may be processed in responding to these rights. We try to respond to all legitimate requests within one month unless otherwise required by law and will contact you if we need additional information from you to honor your request or verify your identity. If you are an employee of a MacStadium customer, we recommend you contact your employer’s system administrator and/or your employer’s point of contact with MacStadium for assistance in correcting or updating your information.



Some registered users may update their user settings, profiles, organization settings and event registrations by logging into their accounts and editing their settings or profiles.



To update your billing information, discontinue your account or request [return or deletion of your Personal Data] and other information associated with your account, please contact us by using the information in the section “Contact Information” section below.

YOUR RIGHTS RELATING TO CUSTOMER DATA



As described above, we may also process Personal Data submitted by or for a customer to our products and services. MacStadium is not responsible for and has no control over the privacy and data security practices of our customers, which may differ from those explained in this Privacy Statement. If your data has been submitted to us in our role as a processor by or on behalf of a MacStadium customer and you wish to exercise any rights you may have under applicable data protection laws, please inquire with the Customer directly.

HOW WE SECURE YOUR PERSONAL DATA



We take precautions including organizational, technical, and physical measures to help safeguard against accidental or unlawful destruction, loss, alteration, and unauthorized disclosure of, or access to, the Personal Data we process or use. While we generally follow our standards to protect Personal Data, no method of storage or transmission is 100% secure. You are solely responsible for protecting your password, limiting access to your devices, and signing out of websites after your sessions. DISCLOSURE OF PERSONAL INFORMATION



We may share your information with third parties as reasonable to operate our business, to provide the websites to visitors and customers, as permitted or required by law, or as directed or authorized by you.

INTERNATIONAL TRANSFER OF PERSONAL DATA



Your Personal Data may be collected, transferred to, and stored by us in the United States and by our affiliates and third parties disclosed above, that are based in other countries. Therefore, your Personal Data may be processed outside your country or jurisdiction, including in places that are not subject to an adequacy decision by the European Commission or your local legislature or regulator, and that may not provide for the same level of data protection.

Data Privacy Framework Program Compliance



MacStadium complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.



MacStadium has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF.



MacStadium has certified to the U.S. Department of Commerce that it adheres to the UK Extension to the EU-U.S. Data Privacy Framework Principles with regard to the processing of personal data received from the United Kingdom in reliance on the UK Extension to the EU-U.S. DPF.



MacStadium has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.



If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the UK Extension to the EU-U.S. DPF Principles, and/or the Swiss-U.S. DPF Principles, the Principles shall govern.

Dispute Resolution



In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, MacStadium commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to JAMS, an alternative dispute resolution provider based in the United States. Arbitration



MacStadium is obligated to arbitrate claims and follow the terms as set forth in Annex I of the DPF Principles, provided that you have invoked binding arbitration by delivering notice to MacStadium and following the procedures and subject to conditions set forth in Annex I of Principles.



MacStadium is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC).



MacStadium remains liable for any cases of onward transfers to third parties within its control.

CHANGES



MacStadium encourages all our visitors to periodically review our Privacy Policy to be aware of any updates. MacStadium reserves the right to update the Privacy Policy periodically, without notice. A change in the effective date will indicate that the Privacy Policy has been updated. Any changes to our Privacy Policy will become effective upon posting of the revised Privacy Policy on our website. The use of our website and our services following such changes constitutes our Visitor’s (and Customer’s) acceptance of the revised Privacy Policy then in effect. In the last 12 months we have disclosed your personal information to third parties in connection with operating our online services, including network identifiers and inferences about your preferences to third party analytics providers. Such disclosure for analytics and advertising purposes may constitute a “sale” of your personal information under California law. Upon verifying your identity and the validity of your request, we will use reasonable efforts to correct your personal information as directed. In certain circumstances, we may not be able to satisfy this request depending on the nature of the personal information and purposes for maintaining it.



5. Right to Opt-out of Selling/Sharing. You have the right to direct us to not sell your personal information at any time. To exercise the right to opt out, you may submit a request to use by visiting our Do Not Sell or Share My Personal Information page. You do not need to create an account with us to exercise your opt out rights. Your right to opt out of ‘sharing’ information is a specific right to prevent the provision of your personal information to a third party for them to target certain advertising to you. You may exercise your ‘do not sell or share my personal information’ rights by contacting us via email at privacy@macstadium.com. We will record your request.



We may not discriminate against you for exercising any of your rights under the California Privacy Rights Act. This means that we may not deny you services or charge you different prices or rates for services or provide you with a different level or quality of services (or suggest that we will do so), in response to a request made under the California Privacy Rights Act.
